A California real estate broker has filed a civil lawsuit against Texas-based Tito’s Handmade Vodka, claiming the distillery can’t claim the vodka is “handmade” because of the sheer volume of bottles sold each year. Tito’s sells more than 15 million bottles of vodka a year, according to The Spirits Business.

Tito Beveridge, founder of Tito’s Handmade Vodka has called the lawsuit “misguided,” while detailing the distilling process, saying the vodka is still made in the original Austin, Texas distillery, in hand made pot stills. In his comments, Beveridge focuses on the head and tail cut tastings of the distilling process.

“The artistry involved in knowing when it’s time to make those cuts is something that cannot be duplicated by even the most sophisticated machines,” Beveridge says, before going on to predict that many other distilleries will find themselves subject to similar lawsuits in the future.
